    Provide accessible alternatives

    The ADA Title II final rule requires state and local governments to ensure web content and documents meet WCAG 2.1 Level AA. Where documents cannot be made natively accessible, an equivalent accessible version must be available.

    The 2024 final rule

    In April 2024, the Department of Justice published the final rule under Title II of the Americans with Disabilities Act, establishing specific technical requirements for web content and mobile applications of state and local government entities.

    The rule mandates conformance with WCAG 2.1 Level AA, covering all web content made available by public entities. This includes documents published on websites, such as PDFs, that form part of an organisation's digital presence.

    Compliance deadlines vary by entity size, with larger entities required to comply by April 2026 and smaller entities by April 2027. The expectation is clear: accessible content is not optional.

    Section 508

    Section 508 of the Rehabilitation Act requires federal agencies to make their electronic and information technology accessible to people with disabilities. This includes all documents published on federal websites.

    The standard aligns with WCAG 2.0 Level AA and is enforced through procurement requirements and internal compliance reviews. Federal agencies that publish inaccessible PDF documents risk both legal challenge and audit findings.
